Brring - "Calling" Shenanigans? Not Paid? Scam?

I have had a ton of people write me about Brring (The company that pays you to get calls from your friends on your cell phone). I think everyone feels like I do - I cashed out my first check on Novemeber 16th, 2007. It is now Feb 6, 2008 and still no check. Since that time I have cashed out three more checks, to make a total of almost $60 - of which I have not seen a penny.
BUT, I have written to Brring customer support a few times and gotten lots of apologies from them as well as a lot of "in two weeks" replies. Two weeks would come and go, without a check.
So today I decided that one of two things are going to happen - either they are going to pay me or I am going to sue them and get my almost $60. Yes, it will probably cost $25 to file the case and another $800 to travel to AZ, where they are located, but its all about principal.
So after I took screenshots of their entire site, including their privacy policy (incase they try to change it, which most scammers do) as well as the faqs, I happened to stumble on the Brring WordPress Blog. It appears that "Brring" posted an entry yesterday, and here it is:

Then, I actually found a proof of payment from Brring to someone. I can't see this person creating a fake check for $10 then posting it on their blog.

So....with that being said - Its wonderful that "Mike" got his ten bucks on November 27th. I'm stall waiting on my $60. I'll gladly update everyone as soon as it arrives. HOWEVER, if it's not here by April 16th (6 months/180 after requested) I will have to move forward. I feel 6 months is ample time to send me a check.

UPDATE: I DID get my check!! Here's an pic of me with my check as proof: http://paidopps.blogspot.com/2008/02/brring-proof-of-payment-i-got-my-check.html

Like you said, I do totally understand being a new company, but the bottom line is that their company being new is NOT our problem. We have held up our end of the deal and earned money. We deserve to be paid in a timely manner because we do put our reputations on the line. This is why it is so important for us to move forward with legal action against companies that are with holding money. As mentioned, I am giving them until May 16th so send me every penny of my cash or I will have no choice but to file a lawsuit. *If* it gets to that point, I will gladly sue on behalf of everyone who is missing funds.
SUGGESTION: If anyone feels they *may* be interested in participating in a suit, be sure to get proof of all the payments you are owed NOW. I have been doing this online gig for a long time and I have seen many companies try to "vanish" (picture AGLOCO). If their site goes down and you have no proof that you ever made a penny or asked for a check, you're SOL. SO take screen shots of when you requested payments. I all ready have screenshots of all the FQSA and privacy policy. I always take these shots when I register for a company because, after my ReviewStream experience, I have found that dishonest businesses will try and alter their privacy policy and FAQs just so they can avoid legal action.
I have even more info on Brring that can be used in court (IF it gets to that point) but I don't want to release it in this article.
So, YOU WILL get your money. I WILL get my money and every one of my readers WILL get their money as well. Hopefully we will have some checks in the next few weeks. But if not, then we will have it soon. After all, we earned it.
I probably got the same response you do yesterday. I guess al we can do is wait. I think they realize that if they don't send check now their company is going to be driven into the ground by angry bloggers.

I have stopped using it primarily because the main person who called me on it didn't realize that the number was actually long distance for her. I was going to use the check to pay her back for her long distance charges if it ever arrives.
All in all though seemed like a great service. I really hope they get their act together.
Here is a link to my proof of payment:

What is going on?
Personally, I signed up for them because they can connect a call from a few cities over from a friend who does not have long distance to me(who does) for a ten second ad. I hope they continue.
Now they may have made some promises they couldn't keep, but really who hasn't? I'll bet if they put "Open Source" in their title instead of "beta" there would be a gang at your front door with Linux discs ready to beat your ass.
Bottom Line:
YOU SIGNED UP FOR A BETA:
Can I repeat: YOU SIGNED UP FOR A BETA!
Just because the INTERNET gives you the ability to BITCH and MOAN, doesn't mean you SHOULD.
BTW, I'm a banker by day, got out of IT long ago, but it is still a very good concept and I really hope it works out.
You may recall that in early June we announced changes to our reward structure. Notice was sent to you via email and posted on our Blog (http://brring.wordpress.com/2008/06/06/big-changes-at-brring/ ). These changes were effective on July 1st.
Today we discovered a bug in our system that erroneously granted rewards based on our old reward structure. We were able to track down the bug in part based on your reports to our Contact Us page (http://www.brring.com/contact.php). The symptom is that some calls were incorrectly rewarded but others were not. We have squashed the bug and reset the rewards to the correct amounts.
You are receiving this message because those corrections impacted your 'Available Rewards' balance.
Please accept our profound apologies for any confusion caused by these corrections to your reward balance.
This is a perfect example of why we are running Brring as a beta - to seek out and squash those bugs that impact your enjoyment of the service. With your continued help, and patience, we'll continue to improve your Brring experience.
Sincerely,
